Even if your property name includes the word "pension," the laws that apply vary by facility type.
Today, we're breaking down the pension facility types every aspiring pension operator needs to understand.
What Is a Pension Business?
A pension is a facility that provides guests with lodging and cooking amenities.
The term "pension" isn't a strict legal classification — it's commonly used to refer to minbak (homestay), lodging facilities, or tourist pensions operating in rural, coastal, or mountain areas.
So a pension might be classified as a lodging business, a rural/fishing village homestay, or a tourist pension.
Which category your pension falls into depends on location, facility size, and other factors.
And the category matters — because each comes with different laws: lodging facilities fall under the 「Public Health Control Act」, rural/fishing village homestays under the 「Rural Community Development Act」, and tourist pensions under the 「Tourism Promotion Act」 in addition to other laws.
This means pension operators must meet the facility standards of the relevant law and file the proper business notification.
Here's how pension types break down by legal category:
Lodging Business vs. Rural/Fishing Village Homestay
So how do you tell a lodging business from a rural/fishing village homestay?
The distinction starts at the operator level.
Anyone can run a lodging business. But a rural/fishing village homestay must be operated by a resident of a rural, fishing, or semi-rural area — in their own detached home — for the purpose of supplementing rural income by offering lodging, cooking facilities, and breakfast to guests.

What Is a Tourist Pension?
So general pensions fall into lodging businesses or rural/fishing village homestays — but what about tourist pensions and resort pensions?
A tourist pension is a lodging operator that provides facilities suitable for nature and cultural experience tourism.
If you meet certain requirements under the 「Tourism Promotion Act」, you can receive official designation as a tourist pension.
Benefits of designation include: the right to display tourism signage at your property and access to financial support for construction and facility upgrades.
What Is a Resort Pension?
Jeju Special Self-Governing Province follows the same 「Public Health Control Act」 for lodging businesses and 「Rural Community Development Act」 for rural/fishing village homestays as the mainland.
However, tourist pensions are not permitted on Jeju. Instead, resort pensions are.
A resort pension is a type of lodging business defined under the 「Special Act on the Establishment of Jeju Special Self-Governing Province and Development of Free International City」.
It refers to a business that provides facilities suitable for guest lodging, cooking, and nature experience tourism — for use by facility members, co-owners, or tourists.
One more thing: Jeju's rural/fishing village homestays follow 「Rural Community Development Act」 standards set by Jeju provincial ordinance (not national Ministry of Agriculture regulations), so there are minor differences from mainland homestays.
